Cupp Law & Mediation offers the following services:

Mediation

Cupp Law & Mediation provides mediation services to individuals and businesses in matters relating to employment issues and disputes involving corporate and business relationships, contracts, and real estate. The mediator's role is to help the parties identify the issues, reduce obstacles to communication, and maximize the exploration of alternatives so the parties can reach a voluntary agreement to resolve their dispute.

Employment Law Representation

Cupp Law & Mediation provides legal representation to individuals in matters related to employment law, including discrimination, sexual harassment, retaliation, whistleblower claims, wage and hour disputes, and defamation. We also provide legal review and advice on employment, severance, non-compete, non-solicitation, and confidentiality agreements.

Attorney and Mediator

Tim Cupp is a native of Rockingham County, Virginia. After practicing law in Fairfax, Virginia and Charlotte, North Carolina, he moved to Harrisonburg, Virginia and in 1992 established Cupp & Cupp, P.C. with his wife, Jeanie. In 2014, Cupp & Cupp merged with Shelley & Schulte, P.C. Tim continued his practice as a partner with Shelley Cupp Schulte, P.C. until starting Cupp Law & Mediation in 2026. While he has handled a wide variety of civil litigation, real estate, and corporate matters in over 40 years of practice, Tim's primary focus has been in the areas of employment law and consumer rights.

Tim's experience with the legal process has offered him an inside view to the differing effect of trials and alternative dispute resolution on his clients and their opponents. He has found that mediation typically provides parties a method of resolving  disputes in a less stressful, less antagonistic, and less expensive forum than a trial by jury.

 

As a mediator, Tim offers his assistance to parties in business, real estate, and employment disputes to help them reach a satisfactory resolution. While he cannot offer legal advice to parties as a mediator, he will use his legal background and experience to facilitate an acceptable settlement between the parties.

Firm Manager

Jeanie Cupp handles case management and administrative matters for Cupp Law & Mediation. She practiced law for over 30 years in North Carolina and Virginia, including as an attorney with her husband, Tim, at Cupp & Cupp, P.C. where her practice focused on estate planning and guardian ad litem services for incapacitated adults and children.

 

She has also worked as an Assistant Vice-President for Legal Affairs at Charlotte-Mecklenburg Hospital Authority, an instructor in James Madison University's Paralegal Studies Program, an Advocate Manager for CASA for Children, and a Social Security Disability Claims Adjudicator.

Legal claims are governed by one or more statutes of limitations, which set forth the time limit for initiating a legal proceeding. To avoid losing the right to assert any claim you may have, you should obtain legal advice as quickly as possible.

Mediations

Mediation is an informal, voluntary, collaborative process that facilitates communication between parties to a dispute through a neutral mediator to help them understand the issues at hand and reach a mutually agreeable resolution. It is a form of alternative dispute resolution that can avoid the time, expense, and stress of a typical court proceeding. Tim Cupp provides mediation services to individuals and businesses in matters involving employment, corporate and business relationships, and real estate. 

Employment Discrimination

There are laws, including Title VII of the Civil Rights Act, the Americans With Disabilities Act, the Age Discrimination in Employment Act, and the Virginia Human Rights Act, that protect employees from discrimination by an employer on the basis of the employee's race, color, religion, national origin, sex, gender, pregnancy, disability, or age. Federal and Virginia laws also prohibit sexual harassment in the workplace. Employees who oppose illegal employment discrimination may also be protected against retaliation by their employer.

Protected Leave

Under the Family and Medical Leave Act, eligible employees may have the right in certain circumstances to return to their jobs after taking a leave of absence for qualified life events, including a serious health condition that makes them unable to perform the essential functions of their job, or caring for a newborn or a spouse, child, or parent with a serious health condition. The Uniformed Services Employment and Reemployment Act provides protected leave from employment for individuals deployed with the armed services or National Guard.

Whistleblower Protection

Employees may be protected from retaliation for reporting to their employer or a government agency an employer's violation of certain laws or regulations, typically relating to fraud or unlawful practices against the government or the public. They may also be protected from retaliation for refusing to follow an employer's direction to violate the law if they notified the employer the refusal was because they were being asked to do something illegal.

Wage & Hour

The Fair Labor Standards Act and other laws establish rights to minimum wage, overtime pay, and certain benefits. The Equal Pay Act provides protection to female employees by addressing income disparity between male and female co-workers. The Virginia Wage Payment Act also provides substantial rights to employees related to their wages.

Defamation

Employees who have suffered damage to their reputation through false statements of fact about their character in the workplace made to third parties may have a cause of action for defamation and may be entitled to recover compensation for damages. Certain false statements may be so offensive that damages are presumed.

Written Contracts

An employment relationship may be governed by employment contracts, non-solicitation and non-compete agreements, severance agreements, and confidentiality agreements. Tim Cupp advises individuals of the rights and responsibilities of employees and employers under such agreements and their impact on an employee's future job opportunities.
